Release of Liability & Participation Waiver

Your Safety Matters to Us!

At Harvesting Change, we believe that learning, creativity, gardening, and community involvement should be enjoyable, rewarding, and accessible to everyone.

We are committed to providing a welcoming environment where individuals and families can participate in educational workshops, creative activities, gardening projects, volunteer opportunities, and community events.

While we take reasonable precautions to promote safety, some activities involve risks that cannot be completely eliminated.

Before participating in Harvesting Change activities, please carefully read the following Release of Liability, Assumption of Risk & Participation Agreement and complete the acknowledgment form at the bottom of this page.

  • Educational classes, demonstrations, and hands-on learning activities.
  • Volunteer projects and community improvement activities.
  • Fundraising events, community gatherings, and special programs.
  • Event setup, cleanup, and other authorized volunteer responsibilities.

Activities may take place at Harvesting Change facilities, partner locations, public spaces, or other approved event sites.

2. Acknowledgment of Potential Risks

I understand that participation in Harvesting Change activities may involve certain risks, including but not limited to:

  • Slips, trips, falls, and uneven walking surfaces.
  • Minor cuts, scrapes, bruises, strains, or other physical injuries.
  • Exposure to gardening tools, equipment, soil, compost, plants, and insects.
  • Exposure to paints, adhesives, craft supplies, or other materials that may cause irritation or allergic reactions.
  • Outdoor conditions, including heat, sun exposure, wind, and changing weather.
  • Physical activities such as lifting, bending, carrying materials, planting, and gardening.
  • Accidental damage to personal belongings.

I understand that these examples do not represent every possible risk associated with participation.

3. Voluntary Participation & Assumption of Risk

I acknowledge that my participation in Harvesting Change programs and activities is voluntary.

I understand that I may choose not to participate in an activity or may stop participating if I feel unsafe or uncomfortable.

By participating, I knowingly and voluntarily accept the ordinary and inherent risks associated with the activities I choose to undertake.

I agree to exercise reasonable care, follow applicable safety instructions, and participate within my personal abilities and limitations.

4. Release of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

In consideration of being permitted to participate in Harvesting Change activities, I voluntarily agree, to the fullest extent permitted by Arizona law, to release Harvesting Change and its directors, officers, authorized volunteers, instructors, and representatives from claims for personal injury, illness, or property damage arising from ordinary negligence connected with my participation in covered activities.

I understand that this release may limit my ability to pursue certain legal claims, including claims arising from the ordinary negligence of a released party.

This agreement does not release claims arising from gross negligence, reckless conduct, willful misconduct, or any other conduct for which liability cannot lawfully be waived.

I acknowledge that I have had an opportunity to review this agreement and ask questions before signing.

5. Participant Responsibilities

To help maintain a safe and respectful environment, I agree to:

  • Follow the Safety Guidelines at Harvesting Change.
  • Comply with instructions provided by authorized instructors, coordinators, and volunteers.
  • Use tools, equipment, and materials only as directed.
  • Wear appropriate clothing and protective equipment when required.
  • Report unsafe conditions, injuries, accidents, or damaged equipment promptly.
  • Respect fellow participants, volunteers, instructors, and visitors.
  • Avoid activities that exceed my abilities or for which I have not received appropriate instruction.
  • Respect organizational property, equipment, supplies, and designated activity areas.

Harvesting Change may restrict or discontinue participation when reasonably necessary to protect the safety and well-being of individuals involved.

6. Health, Allergies & Personal Limitations

I understand that certain activities may involve physical exertion or exposure to materials that could affect individuals with allergies, sensitivities, or other health considerations.

I am responsible for determining whether an activity is appropriate for my personal circumstances and for communicating relevant accommodation or safety concerns when necessary.

I understand that Harvesting Change does not guarantee that all activities will be suitable for every individual.

Reasonable accommodation requests will be considered in accordance with applicable law and available program resources.

7. Emergency Medical Assistance

In the event of an accident, injury, or medical emergency, I authorize Harvesting Change representatives to contact emergency services and provide relevant information to emergency responders.

If I am unable to communicate and immediate assistance is necessary, I authorize emergency medical care as permitted by applicable law.

I understand that Harvesting Change does not guarantee the presence of medical personnel at activities or events.

I acknowledge that I remain responsible for medical expenses to the extent required by law.

8. Children & Minor Participants

Harvesting Change welcomes children and families to participate in age-appropriate educational and creative activities.

For participants under 18 years of age:

  • A parent or legal guardian must provide permission before participation.
  • Children must follow all applicable safety instructions and age restrictions.
  • Parents or guardians are responsible for supervision unless an activity specifically provides an approved supervised program.
  • Children may not use potentially hazardous tools, equipment, or materials without appropriate authorization and supervision.
  • Additional consent or participation documentation may be required for certain activities.

A parent or legal guardian must complete the designated minor participation acknowledgment and consent process.

Any attempted release of a minor’s legal claims is subject to applicable Arizona law and may not be enforceable in the same manner as an adult participant’s release.

9. Personal Property

I understand that I am responsible for securing my personal belongings while participating in Harvesting Change activities.

Harvesting Change is not responsible for lost, stolen, or damaged personal property except where liability cannot legally be excluded.

Participants are encouraged to leave unnecessary valuables at home.

10. Photography & Media Permission

Harvesting Change may photograph or document activities for organizational records, educational purposes, or community outreach.

Signing this waiver does not automatically grant permission for Harvesting Change to use identifiable photographs or videos of me or my child for promotional purposes.

Separate consent will be requested when appropriate.

Declining promotional photography permission will not, by itself, prevent participation in activities.
